B. After Studies - Transitioning to Graduate Work Permit and/or Permanent Residence (PR)

Work Permits

 

a)  Temporary Graduate Visa 485 

 

  • Graduate Work Stream Valid Up to 18 Months - For graduates of eligible 2 years VET Diploma or Certificate programs

  • Post Study Work Stream Valid 24 to 48 Months - For graduates of Bachelor, Masters & PHD

          Bachelor Degree Graduate - Valid up to 2 years. Effective July 1, 2023, may be extended by another 2 years        for graduates of select Bachelor Degree programs (Total of 4 years validity)

          Masters Degree Graduate - Valid up to 3 years. Effective July 1, 2023, may be extended by another 2 years          for graduates of select Masters Degree programs (Total of 5 years validity)


         Doctoral (PHD) - Valid up to 4 years. Effective July 1, 2023, may be extended by another 2 years for                            graduates of all PHP programs ( Total of 6 years validity)
     

b)  Temporary Skill Shortage (TSS) 482

  • Short Term Stream Valid up to 2 Years - Employer sponsored work permit in an eligible job in the MLTSSL or the Regional Occupation List (ROL)

 

  • Medium Term Stream Valid Up to 4 Years with Unlimited Renewal - Employer sponsored work permit in an eligible job either in the MLTSSL or ROL

 

c)  Training Work Visa 407 (Structured Work Based Training) - For graduates of eligible study course           &  education provider

 

d)  Recognized Graduate Visa 486 Valid Up to 18 Months - For eligible Engineering Graduates of                     recognized universities in the last 2 years (Includes University of the Philippines)

 

Permanent Residence (PR) for International Graduates

 

a)  Skilled Migration (Skills Select) - Points Tested

 

  • Skilled Independent 189  – For eligible applicants below 45 years old, with nominated occupation in the SOL &  suitable skills assessment and subsequently issued an Invitation to Apply (ITA)

  • Skilled Nominated 190  - Same as 189 except that this stream requires nomination from Australian State or Territory to which you are awarded 5 points

 

  • Points Tested  - Must obtain a minimum of 65 points.  Studying in Australia can give you as much as 30 points to help you meet the passmark of 65 points

 

 b) Employer Nomination Scheme (ENS) Visa 186

 

  • Direct Entry Stream – Direct PR Application for  eligible applicants nominated by an employer in a  job in the SOL

 

  • Temporary Residence Transition Stream – For eligible applicants who worked for at least 3 years in Australia on TSS Work Visa 482

 

c)  Regional Migration Visas

 

  • Residence Transition Stream - For eligible applicants below 45 years old who worked for at least 3 years in Australia on TSS Work Visa 482 and nominated by an approved employer on a job in Regional Australia

 

  • Skilled Employer Sponsored Regional (Provisional) Visa 494 (Replaced RSMS 187 Visa)  - For eligible applicants below 45 years old nominated by an approved in an occupation   relevant to SOL, with suitable  skills assessment 

 

  • Permanent Residence (Skilled Regional) Visa 191 – For individuals holding a qualifying visa who have lived for at least 3 years in a designated regional area and who have also earned the specified income amount, to reside permanently in Australia.

C. Dependent Visas - For Student's Spouse/Partner and Child Below Age 22

a) Spouse/Partner - Open Work Permit with the same work right as the student

 

b) Child  up to Age 18 may join.  School Aged Child (Ages 5 to 17) must enroll &  study in an                              Australian school

 

c) Dependents may be included in Work Permit and PR applications

A. While Studying -  Student & Work Visas

F1 Student Visa   -  With part time On-campus Work Permit or Off-campus CPT Work Permit

B. After Studies - Transitioning to Graduate Work Permit and/or Permanent Residence (PR)

OPT Graduate Work Permit - For F1 students who graduated in a post secondary program of at least 9 months.  Valid up to 12 months but can be extended by another 24 months (total of 36 months) for degree graduates in the STEM field 

 

H1B Work Visa - Full time employer sponsored work permit valid for 3 years extendible for another 3 years. May further lead to Immigrant  status (e.g. on an EB2 or EB3 visa) upon meeting the immigration requirements.

C. Dependent Visas - For Student's Spouse/Partner and Child Below Age 21

a) Spouse/Partner - May join as student's dependent on an F2 visa but is not allowed to work. Must find an employment sponsor and apply for a work permit (EAD) to be able to work

 

b) Child  up to Age 21 may join on a F2 visa

2. For Refused Cases - During the 1-On-1, we will assist you in determining the most appropriate legal remedy in overturning the visa rejection (re-consideration, re-application or appeal/judicial review). 
If it is a re-application which is the fastest option, we will endeavor to  assist you in determining the best ways to address the specific refusal grounds as well as all the gaps & issues in your application and at the same time, in demonstrating that you meet the existing visa requirements by providing new / additional information and/or supporting evidence in your new application geared to overturn the visa refusal - as we have successfully done to many refused cases.

   

3.  Next Steps After a Positive Assessment in the 1-On-1 - Signing of a covering Retainer Agreement so that we can officially start the process.

  • Third, after submission, we shall assist you and/or provide you with the necessary guidelines in completing and/or submission of  post visa lodging requirements until a decision is made in your application.  If an interview is required, we shall assist you in preparing for an interview by providing you with the necessary interview guides & tips.
