a)  Skilled Migration (Skills Select) - Points Tested

 

  • Skilled Independent 189  – For eligible applicants below 45 years old, with nominated occupation in the SOL &  suitable skills assessment and subsequently issued an Invitation to Apply (ITA)

  • Skilled Nominated 190  - Same as 189 except that this stream requires nomination from Australian State or Territory to which you are awarded 5 points

 

  • Points Tested  - Must obtain a minimum of 65 points.  Studying in Australia can give you as much as 30 points to help you meet the passmark of 65 points

 

 b) Employer Nomination Scheme (ENS) Visa 186

 

  • Direct Entry Stream – Direct PR Application for  eligible applicants nominated by an employer in a  job in the SOL

 

  • Temporary Residence Transition Stream – For eligible applicants who worked for at least 3 years in Australia on TSS Work Visa 482

 

c)  Regional Migration Visas

 

  • Residence Transition Stream - For eligible applicants below 45 years old who worked for at least 3 years in Australia on TSS Work Visa 482 and nominated by an approved employer on a job in Regional Australia

 

  • Skilled Employer Sponsored Regional (Provisional) Visa 494 (Replaced RSMS 187 Visa)  - For eligible applicants below 45 years old nominated by an approved in an occupation   relevant to SOL, with suitable  skills assessment 

 

  • Permanent Residence (Skilled Regional) Visa 191 – For individuals holding a qualifying visa who have lived for at least 3 years in a designated regional area and who have also earned the specified income amount, to reside permanently in Australia.

C. Dependent Visas - For Student's Spouse/Partner and Child up to Age 18 Below

a) Spouse/Partner - Open Work Permit with the same work right as the student

H1B Work Visa - Full time employer sponsored work permit valid for 3 years extendible for another 3 years. May further lead to Immigrant  status (e.g. on an EB2 or EB3 visa) upon meeting the immigration requirements.

C. Dependent Visas - For Student's Spouse/Partner and Child Below Age 21

a) Spouse/Partner - May join as student's dependent on an F2 visa but is not allowed to work. Must find an employment sponsor and apply for a work permit (EAD) to be able to work

 

b) Child  up to Age 21 may join on a F2 visa

2. For Refused Cases - During the 1-On-1, we will assist you in determining the most appropriate legal remedy in overturning the visa rejection (re-consideration, re-application or appeal/judicial review). 
If it is a re-application which is the fastest option, we will endeavor to  assist you in determining the best ways to address the specific refusal grounds as well as all the gaps & issues in your application and at the same time, in demonstrating that you meet the existing visa requirements by providing new / additional information and/or supporting evidence in your new application geared to overturn the visa refusal - as we have successfully done to many refused cases.

   

3.  Next Steps After a Positive Assessment in the 1-On-1 - Signing of a covering Retainer Agreement so that we can officially start the process.
